These Terms and Conditions (hereinafter, “the Legal Notice”), together with the Privacy Policy and the Cookie Policy, govern access to and use of the website accessible through the domain name www.panoramasdmkt.com and its subdomains (hereinafter, “the Website”).

Merely accessing the Website confers on the person doing so the status of User (hereinafter, “the User”) and implies full acceptance of this Legal Notice. If the User does not agree, they must leave the Website without using it.

2. Purpose of the Website

The Website is informational and commercial in nature: it presents PANORAMASDMKT’s services, publishes editorial content and provides the User with contact and subscription forms. The Website does not sell products and does not allow services to be contracted online; any engagement is formalised subsequently, through a specific proposal and contract between the parties.

3. Access to the Website

Access to the Website is free of charge, except for the cost of the connection through the telecommunications network supplied by the access provider contracted by the User. Access does not require prior registration.

4. Rules of use of the Website

The User undertakes to use the Website and all its content and services in accordance with the law, morality, public order and this Legal Notice, and not to use them for unlawful activities, activities that infringe the rights of third parties or that breach the applicable legal system.

By way of example and without limitation, the User undertakes:

  1. Not to introduce or disseminate racist, xenophobic or pornographic content or propaganda, content supporting terrorism, or content that infringes human rights.
  2. Not to introduce or disseminate harmful programs (viruses, worms or similar) that may damage the computer systems of PANORAMASDMKT, its suppliers or third parties.
  3. Not to disseminate or make available to third parties information or content that infringes the fundamental rights and public freedoms recognised by the Constitution and by international treaties.
  4. Not to disseminate information or content that constitutes unlawful or unfair advertising.
  5. Not to transmit unsolicited advertising, promotional material, “junk mail”, “chain letters” or any other form of unauthorised solicitation.
  6. Not to introduce or disseminate false, ambiguous or inaccurate information that misleads its recipients.
  7. Not to disseminate content that infringes the intellectual or industrial property rights, patents or trade marks of PANORAMASDMKT or of third parties.
  8. Not to breach the legislation on the secrecy of communications and the protection of personal data.
  9. Not to use automated means to mass-extract content or email addresses from the Website.

The User will hold PANORAMASDMKT harmless against any claim, fine or penalty arising from a breach of these rules, with PANORAMASDMKT reserving the right to claim compensation for the corresponding damages.

5. Exclusion of liability

Access to the Website does not imply any obligation on PANORAMASDMKT to monitor the absence of viruses or any other harmful computer element. It is the User’s responsibility to have appropriate tools for their detection and disinfection.

PANORAMASDMKT is not liable for damage caused to the User’s or third parties’ software or equipment while browsing the Website, nor for losses arising from failures or disconnections in telecommunications networks that suspend or interrupt the service.

PANORAMASDMKT endeavours to keep the published information accurate and up to date, but does not warrant the absence of typographical errors or the permanent validity of its content, which may be modified without prior notice.

6. Linked content and services

The Website may contain links to other Internet pages and portals (hereinafter, “Linked Sites”). PANORAMASDMKT will only be liable for their content to the extent that it has actual knowledge of its unlawfulness and has not deactivated the link with due diligence. If the User considers that a Linked Site contains unlawful or inappropriate content, they may notify us, although this does not entail an obligation to remove the link.

The existence of Linked Sites does not presuppose agreements with their owners, nor any recommendation by or identification of PANORAMASDMKT with their content or services.

7. Intellectual and industrial property

All the content of the Website — texts, documents, photographs, graphics, images, icons, technology, software, graphic design and source code — is the intellectual property of PANORAMASDMKT or of third parties who have authorised its use, and none of the exploitation rights recognised by current legislation may be understood to be assigned to the User.

The trade marks, trade names and distinctive signs published on the Website are the property of PANORAMASDMKT or of third parties, and the User acquires no rights over them.

Partial quotation of our content is permitted provided the source is stated and the original page is linked. Any other reproduction, distribution or transformation requires prior written authorisation.

8. Data protection

The processing of personal data provided through the Website is governed by our Privacy Policy and, as regards cookies and equivalent technologies, by our Cookie Policy.

11. Applicable law and competent jurisdiction

This Legal Notice is governed by and construed in accordance with Spanish law. Any dispute will be subject to the courts of Madrid, unless the applicable consumer protection legislation mandatorily provides for a different venue.
